國民黨立委江啟臣今天對外指出，他接獲民眾陳情，指我國在沖之鳥礁周邊作業的漁船，收聽到電台廣播，告知漁民「日本將派公務船於沖之鳥海域巡護，於該海域請提高警覺，如得知日方公務船應先行避開，避免造成無謂的損失」，漁民不滿那明明是公海，為什麼要我國漁民避開；農委會漁業署證實此事，確實有廣播請漁民避開。對於漁業署主動廣播要求漁民避開沖之鳥海域，琉球區漁會總幹事蔡寶興表示，沖之鳥礁附近是公海，漁民在那裡捕魚是合法、合理的，之前農委會主委曹啟鴻在立法院答詢時，也說過那裡是公海，漁民可以去護漁，政府現在不是去護漁，反而要漁民躲避，如果其他國家跟日本一樣，那漁民怎麼辦？漁業署副署長黃鴻燕表示，會請漁民先行避開，主要是因為沖之鳥海域目前還是爭議海域，也就是現在我國認為是公海，但是日本卻主張那是他們200海浬的經濟水域，目前，我國與日本雙邊還在談，各自都有各自的立場，有爭議的水域，就是有風險，漁業署不希望漁民被抓，才會廣播。黃鴻燕表示，去年在日本透過海洋事務對話機制，雖然沒有達到協議，不過，成立了工作小組，希望在下一次魚汛還沒來之前可以再啟動對話。不過，漁民普遍很反彈，有漁民認為，既然有爭議、問題還沒有解決，那日本怎麼可以來騷擾我國漁船合法作業，漁業署又怎麼可以叫漁民迴避呢？而且雙邊談判結果至今沒有結論，難不成在還沒有結論之前，漁民就不能去嗎？蔡寶興說，漁民的損失，政府要負責嗎？蔡寶興說，現在日本的關係跟我們很好，但是事實上有沒有呢？漁民的感覺是仍深受打壓，現在普遍十分「火大」；今年沖之鳥海域的漁獲非常地好，不少漁民都整裝待發，準備過完年就要前往作業，不過漁民現在質疑政府到底會不會「硬起來」護漁，如果去作業被扣、被抓怎麼辦？他們不知道現在的政府是否會捍衛他們的權益。
